End-User License Agreement

This End-User License Agreement ("EULA") is a legal agreement between you and Christian Flach ("we," "us," "the developer") regarding your use of the Live Beats WebRadio Android application, package name com.lbwebradio.radio (the "App"). IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS EULA, DO NOT DOWNLOAD, INSTALL, OR USE THE APP.

Summary

  • You must agree to this EULA to use the App. If you agree, you may use it for free (or with the optional PRO purchase) for any lawful purpose.
  • The App plays audio streams from third-party internet radio stations that we don't operate, host, or control. We aren't responsible for the content those stations broadcast.
  • The App is provided "as-is," with no warranties, and we're not liable for how you use it or for the availability of any station's stream.
  • The optional PRO purchase is a one-time unlock processed entirely through Google Play Billing, governed by Google's own terms.
  • This doesn't replace our Privacy Policy, which explains what data the App collects and shares — read that too.
  • You should read the whole agreement below, not just this summary.

The Agreement

By downloading, installing, or using the App, you accept and agree to be bound by the terms of this EULA. If you do not agree to all of the terms of this EULA, you may not download, install, or use the App. This EULA applies in addition to, and does not replace, Google Play's own Terms of Service, which also govern your use of the App as distributed through Google Play.

The License

Subject to your compliance with this EULA, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal, non-commercial use. The App is licensed, not sold, to you. We reserve all rights in the App not expressly granted to you in this EULA.

The Restrictions

  • You must use the App in a manner that complies with applicable laws in the jurisdiction(s) in which you use it.
  • You may not sell, resell, rent, lease, sublicense, or otherwise exchange the App or your license to use it for anything of value.
  • You may not reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent applicable law expressly permits this despite the restriction.
  • You may not repackage, rebrand, or redistribute the App, or bundle it with other software, without our prior written permission.
  • You may not remove or alter any proprietary notices, trademarks, or branding included in the App.
  • You may not use the App to violate the terms of service of any radio station, directory service, or other third party the App connects to on your behalf.

Third-Party Radio Stations and Content

The App is a player and directory for internet radio streams broadcast by thousands of independent, third-party stations. We don't operate, host, curate, pre-screen, or control these stations or the content they broadcast — including audio content, station names, artwork, or metadata. Station availability, stream quality, and content are entirely outside our control and can change or stop working at any time without notice, and some stations broadcast over an unencrypted (http://) connection rather than an encrypted one, as described in our Privacy Policy. You use the App's access to third-party stations at your own discretion, and we're not responsible for the content of any station you choose to listen to, or for any station becoming unavailable, changing its stream, or ceasing to broadcast.

PRO Purchases

The App offers an optional, one-time PRO purchase that unlocks additional features. This purchase is processed entirely through Google Play Billing; we never receive or store your payment details. Refunds, billing disputes, and purchase management are handled by Google under its own Play Terms of Service and refund policy, not by us directly, though you're welcome to contact us with any issue and we'll do what we reasonably can to help.

Privacy

The App's data collection and sharing practices — including what stays on your device and what technical data (like search terms or crash diagnostics) is sent to third-party services — are described in full in our Privacy Policy, which forms part of this agreement by reference. Some of these can be turned off in Settings, as explained there.

App Updates

We may release updates to the App from time to time to fix bugs, improve features, or address security issues. Updates are delivered through Google Play and installed according to your own device and Play Store settings — we don't push updates directly or bypass Google Play's update mechanism. You're not required to install every update, but some features may not work correctly, or the App may stop working entirely, on an outdated version.

Open-Source Notices

The App uses a number of open-source software components (including, among others, Jetpack Compose, Media3/ExoPlayer, Room, and kotlinx.serialization), each governed by its own open-source license. Where the terms of an open-source component's license conflict with this EULA, the terms of that license apply instead, to the extent of the conflict, and any restriction in this EULA that a component's license prohibits does not apply to that component. If a license applicable to a component requires us to make an offer to provide source code, that offer is made by this notice, and you may exercise it by contacting livebeatswrp@gmail.com.

Intellectual Property

The App itself — its design, original code, branding, and associated documentation, apart from the third-party open-source components and third-party content described above — is the property of Christian Flach. We reserve all rights not expressly granted to you in this EULA.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. YOUR USE OF THE APP IS AT YOUR OWN RISK. WE DO NOT WARRANT THAT: (I) THE APP WILL MEET YOUR REQUIREMENTS; (II) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) ANY THIRD-PARTY RADIO STREAM, ITS CONTENT, OR ITS AVAILABILITY WILL MEET YOUR EXPECTATIONS OR REMAIN AVAILABLE; OR (IV) ANY DEFECTS IN THE APP WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES — ARISING FROM OR RELATED TO: (I) YOUR USE OF, OR INABILITY TO USE, THE APP; (II) THE CONTENT, AVAILABILITY, OR UNAVAILABILITY OF ANY THIRD-PARTY RADIO STATION OR STREAM ACCESSED THROUGH THE APP; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DEVICE OR DATA; (IV) STATEMENTS, CONDUCT, OR CONTENT OF ANY THIRD PARTY ENCOUNTERED THROUGH THE APP; OR (V) ANY OTHER MATTER RELATING TO THE APP — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THIS EULA LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Changes and Discontinuation

We reserve the right, at any time, to modify, suspend, or discontinue the App (or any part or feature of it), with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

Termination

This license is effective until terminated. We may terminate it if you fail to comply with any term of this EULA. Upon termination, you must stop using the App and, if applicable, uninstall it. Sections of this EULA that by their nature should survive termination (including Intellectual Property, Disclaimers, and Limitation of Liability) will continue to apply.

Governing Law

This EULA is governed by the laws of Sweden, without regard to its conflict of law principles, except where mandatory consumer protection laws of your own country of residence provide otherwise and cannot be waived by agreement.

Changes to This Agreement

We may update this EULA from time to time. If we do, we'll update the "Last updated" date above. Continuing to use the App after a change takes effect means you accept the updated terms.
